The March 2021 variation of the 2011 Hunter Valley Network Access Undertaking (HVAU) expires on 31 December 2026.
ARTC has indicated to the ACCC it will seek the ACCC’s consent to vary the HVAU under paragraph 44ZZA(7)(b) of Part IIIA of the Competition and Consumer Act 2010 (CCA).
On 17 September 2025 ACCC sent a letter to ARTC regarding the upcoming Hunter Valley Access Undertaking submission. This letter provides initial guidance to assist ARTC with pre-lodgement drafting for the submission.
The ACCC will undertake a regulatory assessment of an undertaking application once lodged.

Background
The HVAU is a voluntary undertaking between the ACCC and ARTC. The HVAU was first accepted by the ACCC in 2011 and is in its eighth variation.
