Businesses wishing to engage in conduct that would or might breach the competition law may be able seek an exemption for that conduct from the ACCC through its 'notification' or 'authorisation' processes.

Once a notification takes effect or upon authorisation being granted, the business can engage in the notified or authorised conduct without risk of breaching the competition law. However, this protection only applies for conduct engaged in after the notification takes effect or authorisation is granted. You should seek legal advice or contact the ACCC if you are considering this option.
