Merger control in Australia is changing

It is currently not compulsory for businesses to notify the ACCC of their merger or acquisition.

A new mandatory merger control regime starts on 1 January 2026. Under this regime businesses contemplating an acquisition that meets certain thresholds must notify the ACCC and wait for approval before their acquisition can proceed.

Businesses can notify on a voluntary basis from 1 July 2025.
