Merger control in Australia is changing

It's not compulsory under the current system for businesses to notify the ACCC of their merger or acquisition. 

A new mandatory merger control regime starts on 1 January 2026. Businesses contemplating acquisitions which meet certain thresholds will be required to notify the ACCC and wait for approval before their proposed acquisition can proceed. 

A voluntary period and other changes will come into effect from 1 July 2025.
