Under the ACL the Commonwealth, state and territory ministers can regulate consumer goods and product-related services by issuing safety warning notices, banning products on a temporary or permanent basis or issuing a compulsory recall notice to suppliers. The Commonwealth minister can also impose mandatory safety or information standards.
All suppliers in the supply chain must comply with these laws. A business or person who breaches a criminal offence provision under the product safety laws may be found guilty of a criminal offence and be subject to pecuniary criminal penalties. Civil remedies are also available for breaching the product safety provisions.
