Businesses that have substantial market power must be careful to ensure that their conduct would not have the purpose, effect or likely effect of substantially lessening competition.

If concerned that certain conduct may raise concerns under the competition provisions of the CCA, the business should consider applying for an exemption from the ACCC prior to engaging in the conduct.
