Obligations of repairers
The ACL requires repairers to notify consumers:
- if it is the practice of the repairer to supply refurbished goods as an alternative to repairing a consumer's defective goods or to use refurbished parts to fix defective goods, and/or
- that data may be lost when goods capable of storing data generated by the consumer are repaired.
The repairer must not, in trade or commerce, accept goods from the consumer if the repairer does not give the consumer a notice that complies with the requirements mentioned above.
Businesses that fail to comply with these requirements are liable to civil and criminal penalties and other sanctions.
