Wrongly accepting payment

It is an offence for a business to accept payment before goods or services are provided if, at the time of acceptance:

  • it doesn't intend to actually supply the goods or services
  • it intends to supply different goods or services
  • there are reasonable grounds to believe that the business won't be able to supply the goods or services within the specified time (or if no time is specified, a reasonable time).
