The Competition and Consumer Act 2010 (the CCA) contains compulsory information-gathering powers under s. 155 that enable the Australian Competition and Consumer Commission (ACCC) to obtain information, documents and evidence in relation to its enforcement functions, certain authorisation and notification decisions and regulatory matters.

This guide will be updated to reflect that from 1 January 2023, the value of a penalty unit will increase from $222 to $275. This change will mean that the maximum fines referred to on page 7 of the guide for a refusal or failure to comply with a s. 155 notice by the due date will increase to $27,500 for individuals and $137,500 for companies.
