On 30 January 2025, the ACCC issued a draft determination proposing to grant authorisation to Wilmar Sugar Trading Pty Ltd, Wilmar Sugar Pty Ltd, Tully Sugar Limited, MSF Marketing Pty Ltd, Queensland Commodity Service Pty Ltd, Bundaberg Sugar Ltd, and Queensland Sugar Limited to collectively negotiate and execute storage and handling agreements with Sugar Terminals Limited.

The ACCC is proposing to grant authorisation for 5 years.

The ACCC has also granted interim authorisation to enable the applicants to collectively negotiate and execute agreements, but not to give effect to any agreements, whilst the ACCC is considering the substantive application.

The ACCC seeks responses to the draft determination by 21 February 2025.
