The ACCC proposes to grant authorisation to enable Hunter Valley Coal Chain Coordinator Limited (HVCCC) and coal chain participants to continue to engage in planning and coordination activities, including sharing information, for the cooperative operation and alignment of the Hunter Valley coal supply chain.
HVCCC has been performing these activities since 2009 under an existing authorisation which will expire on 31 December 2024. Over this time, it is broadly recognised these arrangements have delivered significant efficiency benefits to the industry, and no evidence of harm to competition has been obtained by the ACCC. The new application does not involve any changes to HVCCC’s activities.
The ACCC proposes to grant authorisation for 10 years, until 31 December 2034.
The ACCC is now seeking submissions in response to the draft determination by Wednesday 15 May 2024, before making its final decision.
Further details about the application, the ACCC’s draft decision and how to make a submission are available on the ACCC's public register.
