The ACCC has published a discussion paper for the superfast broadband access service (SBAS) access determination inquiry that commenced on 15 January 2025.
The SBAS is the regulated wholesale service that retailers use to supply broadband to households and businesses that are connected to superfast fixed-line networks other than the NBN. A superfast broadband network is one that is normally capable of download data speeds of 25 Mbps or higher.
The discussion paper seeks stakeholders’ views on whether to include additional regulated access terms in the SBAS access determination regarding the locations and characteristics of the points of interconnection for retailers to acquire a declared SBAS and, if so, the form of those requirements. The ACCC also seeks views on other price and non-price access terms for inclusion.
Access seekers can nominate that the SBAS be supplied to them on the regulated terms that are specified in an access determination. As such, an access determination can help inform the commercial offers that network owners make, and provide access seekers greater certainty over the terms and conditions that would apply in the absence of a commercial agreement.
The ACCC welcomes submissions from stakeholders on this discussion paper by 5 pm AEDT on Wednesday 28 March 2025.
