On 27 February 2012, the ACCC accepted Telstra’s structural separation undertaking (SSU) and approved the draft migration plan. The SSU came into force on 6 March 2012 and the Migration Plan came into force on 7 March 2012 after the Minister made declarations under sections 577J(3) and (5) of the Telecommunications Act 1997 (Cth). The SSU provides a number of commitments relating to dispute resolution, including for the establishment of an Independent Telecommunications Adjudicator (ITA). The SSU requires Telstra to establish a company limited by guarantee to administer a process for the resolution of complaints from wholesale customers relating to Telstra’s delivery of non-price equivalence in the supply of Regulated Services and in relation to disputes arising under Telstra’s Migration Plan (together referred to as “ITA Disputes”). Before the ITA can commence operation, Telstra must develop an ITA Constitution and a Charter of Independence for ACCC approval. The ACCC must approve an ITA Constitution and Charter of Independence that meet the SSU requirements. The ACCC has the discretion to undertake “public or other consultation which it reasonably considers is necessary or expedient” in relation to drafts of either document. ITA documents On 3 May 2012 the ACCC approved the ITA Constitution after Telstra made amendments to the draft version, addressing concerns raised by wholesale customers during the consultation process.
