On 19 November 2013, NBN Co Ltd lodged a varied SAU with the ACCC. NBN Co lodged this varied SAU in response to the ACCC's notice to vary given to NBN Co on 8 October 2013.

Time period for making a decision on the SAU

The ACCC must make a decision to accept or reject an SAU within six months of the receipt of the SAU, subject to its ability to extend this period. If the ACCC does not make a decision within the statutory time period, it is deemed to have accepted the SAU.

Under section 152CBDA(3) of the Act, the ACCC must consider a varied SAU given in response to an ACCC notice to vary instead of the original SAU. Accordingly, the statutory time period applies from the receipt of the December 2012 SAU, rather than the November 2013 SAU. The ACCC expects to be able to make a final decision on whether to accept or reject the November 2013 SAU by the end of December 2013.
