The High Court today granted the Australian Competition and Consumer Commission's special leave application to appeal in its case against Rural Press Limited & others.

The appeal will concern the application of section 45 of the Trade Practices Act 1974, which relates to the agreements that lessen competition (an in particular the meaning of 'exclusionary provisions' as defined in section 4D) and section 46, which relates to the misuse of market power.

The High Court also granted Rural Press's application for special leave to appeal.
