A booklet dealing with the Australian Competition and Consumer Commission role in the approval of Certification Trade Marks has been issued.

A CTM is a sign used to distinguish goods or services :

  • dealt with or provided in the course of trade; and
  • certified by the owner of the CTM, or another person approved by the owner, in relations to the quality, accuracy or other characteristics including, in the case of goods, origin, material or mode of manufacture from other goods or services provided.

The ACCC is required to assess the CTM in terms of a statutory test and also required to consider variations to the rules of CTMs and assignments of registered CTMs.

The booklet outlines the ACCC's requirements and assessment process, appeals procedures, assignments of CTMs and variations of rules. Certification Trade Marks is available, free, from all ACCC offices in each capital city and Townsville and Tamworth.
