The Australian Competition and Consumer Commission has instituted further criminal proceedings in the Federal Court, Brisbane, against Dimmeys Stores Pty Ltd in respect of the supply of children's nightwear that allegedly does not comply with the mandatory consumer product safety standards.

The latest action concerns girls' nightdresses purchased at Dimmeys Richmond store in Melbourne in November 2000. The garments are "T" shirt style girls' nightdresses of the "Just Dreaming" brand.

In November 2000, the ACCC instituted criminal proceedings in the Federal Court, Brisbane, against Dimmeys for supplying in Townsville items of children's nightwear that allegedly did not comply with the mandatory standards for such garments.

Following requests from the ACCC, Dimmeys instituted a chain-wide consumer product safety recall of the "Just Dreaming" nightdress with an offer of a full refund or replacement garment to consumers.

Under the Act, companies can be fined up to $200,000 per offence and individuals up to $40,000 per offence.

Dimmeys has been summonsed to appear on 22 February 2001 in the Federal Court Brisbane.
