ACCC calls for comment on Sonic's proposed acquisition of assets of the Delta imaging group

The Australian Competition and Consumer Commission has released a Statement of Issues on the proposed acquisition of assets of Delta Imaging Pty Limited (in liquidation), Delta Imaging Maitland Pty Limited (in liquidation) and Cscan Asset Pty Limited (in liquidation), collectively, the Delta Imaging Group by Sonic Healthcare Limited (Sonic).

Sonic provides general diagnostic imaging services and MRI services in Newcastle and Maitland in NSW. The Delta Imaging Group also provided these services prior to it being placed in liquidation.

The ACCC’s preliminary view is that the proposed acquisition is likely raise competition concerns in relation to the supply of MRI services in Newcastle.

The ACCC is also concerned that the acquisition may raise competition concerns in the markets for the supply of general diagnostic services and MRI services in Maitland.

“Outside of the public hospital system, the MRI units operated by Sonic and the Delta Imaging Group are the only MRI units capable of providing Medicare eligible MRI services. The ACCC is concerned that if Sonic acquires the Delta Imaging Group’s MRI units, this will remove the potential for strong price competition in the supply of MRI services,” ACCC Commissioner Dr Jill Walker said.

The ACCC invites further submissions from the market in response to the Statement of Issues by 13 January 2014. Subsequently, the ACCC's final decision will be deferred until 23 January 2014.
