The Australian Competition and Consumer Commission today issued a Statement of Issues relating to proposed acquisitions involving Wonderest Limited (trading as Sleepyhead) and Pacific Brands Limited (Pacific Brands).

The proposed acquisitions are of:

  • The proposed acquisition of Pacific Brands' Sleepmaker bedding business and Dunlop Foams foam business by Sleepyhead; and
  • The proposed acquisition of Sleepyhead's underlay business (trading as Wonderlay) by Pacific Brands.

The Statement of Issues seeks further information on certain competition issues, particularly in relation to the polyurethane foam market, which have arisen from the ACCC's review to date.

The ACCC invites further submissions from the market in response to the Statement of Issues by 4 February 2011. As a result, the ACCC's final decision will be deferred until 24 February 2011.

The Statement of Issues will be available on the public merger register on the ACCC website.
