My thanks to the organizers for making this happen in such a wonderful part of the world. \par \par Like my colleagues beside me, I\rquote m going to talk to you about how Canada\rquote s competition authority, the Competition Bureau, tracks down and breaks up cartels. During the course of my brief presentation we will undoubtedly notice similarities with other jurisdictions and we will notice that there are inevitable diffe rences as well. \par \par In a world where boundaries are increasingly porous, it\rquote s not really very surprising that trends in Canada might have echoes in Korea or Germany for example and most certainly in the UK. Also, with initiatives like this one taking place m}{ \lang4105\langfe1033\langnp4105\insrsid5319578 ore frequently and at diffe}{\lang4105\langfe1033\langnp4105\insrsid3028749 rent levels among various organizations, there is bound to be and there should be a certain amount of cross-border harmonization of laws, policies and procedures. \par \par What is fascinating, however, are the differences. The employees are primarily investigato rs, lawyers and economists who work in one of four enforcement branches: Civil Matters, Criminal Matters, Fair Business Practices and Mergers. The head of }{\lang4105\langfe1033\langnp4105\insrsid5319578 the }{ \lang4105\langfe1033\langnp4105\insrsid3028749 Competition Bureau is the Commissioner of Competition, Sheridan Scott. \par \par \par }\pard\plain \s1\ql \li0\ri0\keepn\widctlpar\aspalpha\aspnum\faauto\outlinelevel0\adjustright\rin0\lin0\itap0 \b\f1\fs22\lang4105\langfe1033\cgrid\langnp4105\langfenp1033 {\insrsid3028749 Criminal Matters Branch \endash Enforcing the Law \par }\pard\plain \ql \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0 \f1\fs22\lang1033\langfe1033\cgrid\langnp1033\langfenp1033 {\lang4105\langfe1033\langnp4105\insrsid3028749 \par The core of the Competition Bureau\rquote s antitrust work is the Competition Act, which has its foundation in competition laws that were passed in Parliament in 1889. \par \par It is the Bureau\rquote s Criminal Matters Branch that is responsible for enfor cing the criminal anti-cartel provisions of the Competition Act. Our anti-cartel provisions include conspiracy and bid rigging. These offences are prosecuted before criminal courts that may impose fines, order imprisonment, issue prohibition orders and in terim injunctions, or any combination of these. \par \par When a breach of the Act has occurred the Bureau can and does initiate investigations. In general however, the Bureau relies extensively on a complaints-based system before launching costly and time-consumin g investigations. In most cases investigations are launched after a customer or an actual informant complains of collusion. These preliminary investigations focus on gathering facts, authenticating information and developing a theory of competitive harm t o determine whether there are enough grounds for a formal inquiry. \par }{\lang4105\langfe1033\langnp4105\insrsid8596807 \par }\pard \ql \li0\ri0\widctlpar\faauto\rin0\lin0\itap0\pararsid8596807 {\lang4105\langfe1033\langnp4105\insrsid8596807 We believe our record over the past twelve years clearly demonstrates Canada's commitment to prevent and deter cartels aimed at Canada. Since 1992, more than 40 convictions under the Compe tition Act have been entered against corporations and individuals in relation to cartels involving a variety of products. These were all the result of guilty pleas. In one case, a former employee was sentenced to a nine-month term of imprisonment. It was only in the 1990\rquote s, however, that competition authorities in Canada and elsewhere began to detect and address large numbers of international cartel cases in a concerted way. Why this was so would make an interesting topi c for another day. It is sufficient to say that, whatever the reason, it has led to an avalanche of international cartel cases. \par \par Aptly characterized recently by ACCC\rquote s Chairman, Graeme Samuel as a \'93\'85cancer on the economy, a silent extortion...\'94 cartels carry on being worthy of our concerted efforts to detect and destroy them. \par \par In fact, over the past ten years, international cooperation through the harmonizing of laws and investigative techniques, treaties, inter-agency agreements and multi-lateral fora such as the International Competition Network\rquote s Cartel and Leniency Workshops hosted by the ACCC this week, have lead to many successes.
