Guide to exclusive dealing notifications

This guide has been produced to help people better understand the approach the ACCC will take when considering exclusive dealing notifications. It replaces the ACCC’s Guide to authorisation and notification for third line forcing conduct (1998).

This publication has been updated to refer to the Competition and Consumer Act 2010 which replaces the Trade Practices ACT 1974 on 1 January 2011.  For more information on the Australian Consumer Law changes see www.consumerlaw.gov.au.

The ACCC is currently conducting a comprehensive review of this Guide. The ACCC anticipates releasing a draft revised Guide for public comment later this year. Once the review is completed, a new version of the Guide will be published. In the interim, the Commission will continue to apply the Guide when assessing notifications.
