Legislation

The ACCC enforces the Trade Practices Act 1974 (TPA). We do not maintain copies of this legislation on our website as it is maintained on both the Comlaw and Austlii websites. ComLaw, incorporating the Federal Register of Legislative Instruments (FRLI) is the legal information retrieval system owned by the Australian Attorney-General's Department and Austlii is an educational site.

The ACCC applies the National Gas Code to regulated transmission pipelines. The Code is available on the National Gas Pipelines Advisory Committee (NGPAC) site.

The Trade Practices Act aims to enhance the welfare of Australians by promoting competition and fair trading and providing for consumer protection.

Exceptions under commonwealth, state & territory legislation

Some Commonwealth, state and territory Acts permit conduct that would normally contravene the Trade Practices Act. Section 51(1) of the Trade Practices Act provides that such conduct may be permitted if it is specifically authorised under those other Acts.
