Description
The Commission is responsible for handling complaints under the Racial Discrimination Act 1975, Sex Discrimination Act 1984, Disability Discrimination Act 1992 and the Human Rights and Equal Opportunity Commission Act 1986. Under each of the Acts, complaints of discrimination or breaches of human rights are made to the Commission. The President is responsible for inquiring into and attempting to conciliate the complaint. Where a complaint is terminated for some reason the complainant may then apply to the Federal Court of Australia to have their allegations heard and determined.

The Equal Opportunity Commission provides three main services in South Australia:information, education and assessing and resolving complaints
We provide education and training to individuals, organisations and businesses to create a better understanding of EO laws. This helps people understand how to prevent problems and respond to problems if they arise. Our complaint handlers assist people to reach an agreement if a complaint of discrimination or harassment is made. We do not act as advocates. Our aim is to bring people together to try to resolve the complaint. If a complaint cannot be resolved, it may be referred to the Equal Opportunity Tribunal.

The Equal Opportunity Commission has two major roles. The first is to encourage recognition and an understanding of the principles of equal opportunity. The second is to provide a means of redress to individuals who allege unlawful discrimination. Since the Equal Opportunity Act was proclaimed in 1985, the Equal Opportunity Commission has received more than 60,000 enquiries and handled 4,500 complaints.
