Access Determinations for domestic transmission capacity service

Final Access Determination (FAD)


The ACCC published a final access determination (FAD) for the domestic transmission capacity service (DTCS) in June 2012. The DTCS FAD was published with an Explanatory Statement, a report from Data Analysis Australia (DAA) on the linear regression model used to develop the price terms in the FAD, a DTCS Pricing Calculator and a DTCS Route Category Workbook. Draft DTCS FAD

On 9 December 2011 the ACCC published a Draft DTCS FAD for consultation. The Draft DTCS FAD was published with an Explanatory Statement, a Draft DTCS Pricing Calculator, Draft Route Category Workbook and a report from DAA about the regression model used to develop the price terms in the Draft DTCS FAD. These materials are available below.







On 20 January 2012 the ACCC published a summary of the DTCS service providers' pricing data used to develop the price terms in the Draft DTCS FAD. The summary dataset is a random, anonymous, selection of 10 per cent of the observations relating to exempt services. Observations relating to declared services have not been used to develop the price terms in the Draft DTCS FAD. The ACCC releases the summary dataset in accordance with section 155AAA(17) of the Competition and Consumer Act 2010 to provide further transparency about the methodology used to develop the price terms in the Draft DTCS FAD. DTCS Final Access Determination (FAD) inquiry background

The ACCC commenced a public inquiry into making an FAD for the DTCS on 15 June 2011. Under the Competition and Consumer Act 2010, the ACCC must make an FAD within six months of starting the public inquiry, unless this period is extended.  The ACCC extended this period on 9 November 2011 to 29 February 2012 and again to 30 June 2012.




A discussion paper was released on 15 June 2011 and a draft regression model was issued on 21 July 2011. These documents are available below.



On 11 August, the ACCC hosted a Forum in Sydney, Melbourne and Canberra as part of the inquiry. The Forum was attended by representatives from AAPT, Aurora Energy, Basslink Telecom, Competitive Carriers Coalition, Frontier Economics, Department of Broadband, Communications and the Digital Economy (C/W), Department of Premier and Cabinet (Tas), Department of Business and Innovation (Vic), Herbert Geer, Macquarie Telecom, NBN Co, NextGen, Optus, Primus Telecom, Telstra, VHA and TransACT. Interim Access Determination (IAD)

On 18 April 2011 the ACCC made an IAD for the declared domestic transmission capacity service (DTCS).

The IAD was backdated to commence on 1 January 2011 and expire on 31 December 2011. On 9 November 2011 the ACCC made a declaration pursuant to subsection 152BCF(10) of the Competition and Consumer Act 2010 to extend the expiry date for the DTCS IAD to the day immediately before the day on which the DTCS FAD comes into force. The declaration can be found below.

The IAD will be automatically revoked once the ACCC issues a FAD for the declared DTCS.
