Decision to vary the fixed line services final access determinations

On 29 June 2012, the ACCC varied the fixed line services final access determinations (FADs). The ACCC temporarily removed the requirement to provide wholesale line rental, local carriage service and a subset of the public switched telephone network originating access service called preselect and override services over the NBN. Below is a public version of the final report, the variation instrument and the final access determinations as varied. These instruments are also published on the public register of access determinations.  

In accordance with clause 4.1B of the FADs, clause 4.1A of the FADs expired on 7 December 2012.

Public consultation process

On 5 April 2012 the ACCC commenced a public inquiry on varying the final access determinations for the declared wholesale line rental, local carriage service and a subset of the public switched telephone network originating access service called preselect and override services. Telstra has requested the ACCC make this variation.

This inquiry will consider whether the application of the category A standard access obligations should be removed where these services are supplied over National Broadband Network greenfield estates until 31 March 2013. The ACCC has released a discussion paper to assist industry and other interested parties in making submissions to the inquiry. This discussion paper provides the background to the proposed variation, the assessment framework for making a decision and the ACCC’s preliminary views.

The ACCC invites submissions from interested parties no later than 5pm on Friday 11 May 2012. Please email submissions, in Microsoft Word or PDF format, to accessdeterminations@accc.gov.au. Below is a copy of the discussion paper for this inquiry.



Confidentiality arrangements for the inquiry

To support its request for variation, Telstra provided the ACCC with a letter outlining the reasons for its request. This letter contains confidential material and may be obtained by interested parties entering into a confidentiality undertaking with Telstra. The ACCC received the following public submissions in response to the discussion paper published on 5 April 2012. Optus also provided a submission that contains confidential information. Telstra provided a reply submission on 5 June 2012.
