Prior to commencement, the ACCC published an enforcement guideline outlining its' approach to enforcing the Water Market Rules 2009 and the Water Charge (Termination Fees) Rules 2009.
In September 2010, the ACCC accepted a court enforceable undertaking from Murrumbidgee Irrigation Limited and issued it with three infringement notice penalties, totalling $66,000, following multiple breaches of the Water Charge (Termination Fees) Rules 2009.
In July 2010, the ACCC accepted a court enforceable undertaking from Murray Irrigation (MI) in which MI admitted that its conduct breached rule 5(1) of the Water Charge (Termination Fees) Rules 2009 because it imposed termination fees that exceeded the maximum amount authorised under the Rules.
