The ACCC may issue an
infringement notice under section 156 of the Water Act where it has reasonable
grounds to believe that a person has contravened civil penalty provisions set
out in the Water Charge Rules, Water Market Rules or referred to in regulations.
Once an
infringement notice penalty is paid, the ACCC may not commence court proceedings
in relation to that alleged contravention.
A person is
not to be regarded as having been convicted of an offence or to have contravened
a civil penalty provision merely because they have paid an infringement notice
penalty.
