The ACCC considered the competitive effects of the acquisition in the context of a national market for the supply of freight forwarding and line haul services by road for general freight.
Competition analysis
The ACCC formed the view that the acquisition was unlikely to substantially lessen competition in the relevant market for the following reasons:
- there remain a number of significant providers of integrated freight forwarding and line haul services which offer comparable services to the merged firm;
- there are also a high number of second-tier and smaller transport operators which are likely to be able to expand relatively quickly in response to a price increase by the merged firm; and
- the acquisition represents a small incremental increase in Toll Limited's share of sales in the relevant market.
