The ACCC considered the proposed acquisition in the context of the following relevant markets:
- the northern Sydney regional market for the supply of private hospital services to health funds and the Repatriation Commission; and
- the northern Sydney regional market for the supply of private hospital services to patients.
Competition analysis
The ACCC considered that the proposed acquisition was unlikely to substantially lessen competition in any relevant market due to:
- the small increase in market concentration;
- the limited competition between Sydney Adventist Hospital and Dalcross Private Hospital given their focus on different specialties; and
- the presence of alternative private hospital operators in northern Sydney that would continue to provide an effective competitive constraint on the merged firm.
