Market definition
In its evaluation of the proposed acquisition, the ACCC considered markets comprising both lamb and sheep and markets comprising only lamb, within the context of:
- the acquisition market within South Australia, New South Wales and Victoria; and
- the national market for the sale of processed meat.
For the purposes of its competition analysis, the ACCC did not consider it necessary to form a definitive view regarding market definition.
Competition analysis
The ACCC considered that the proposed acquisition was unlikely to result in a substantial lessening of competition irrespective of the market definition adopted. Factors informing this decision included:
- the presence of a number of competing businesses in the relevant markets; and
- that the proposed acquisition would result in a small aggregation of market share in each of the relevant markets.
