In between 2006 and 2008 Global Green Plan Ltd operated a retailer of GreenPower known as GreenSwitch. During this time, GreenSwitch entered into agreements with customers to purchase and surrender a total of 11,300 Renewable Energy Certificates (RECS). However, during this period GreenSwitch only purchased 7163 RECS. This represents a shortfall of 4,137 RECS that Greenswitch had agreed to purchase and surrender on behalf of customers but had not done so.
Global Green Plan Ltd has acknowledged that it breached the Trade Practices Act 1974 by:
making misleading representations in relation to the future purchase of RECS with money provided by customers
making representations that Global Green Plan’s services had an environmental benefit that they did not have
making representations, in between September 2008 and November 2008, that they had an approval or affiliation with the National Greenpower Accreditation Program that it did not have.
Global Green Plan Ltd have provided court enforceable undertakings to the ACCC that it will purchase and surrender the RECS which it failed to purchase on behalf of its customers. The directors of Global Green Plan Ltd, Mr Donald Hewett and Mr Henry Hewett, have provided court enforceable undertakings to the ACCC that they will attend a Trade Practices Compliance Seminar.
