Cartel reform and compliance with the Trade Practices Act

Summary

The ACCC has articulated a firm policy position on serious cartel conduct - such matters will be referred to Australia's public prosecutor for consideration of criminal prosecution. A person will not be permitted to seek to 'trade off' a possible criminal prosecution with civil settlement. The new dual civil and criminal cartel enforcement regime will allow the ACCC to respond to cartel conduct in a proportionate and appropriate way in the interests of all Australians.
