Further draft decision

On 23 September 2009 the ACCC published a further draft decision on each of the proposed Access Undertakings (the Undertakings) lodged by Co-operative Bulk Handling Ltd (CBH), GrainCorp Operations Limited (GrainCorp) and ABB Grain Ltd (ABB) during April 2009.

The views set out in these further draft decisions followed public consultation on the first draft decisions published on 6 August 2009, and offered the parties clear guidance as to the type of access undertakings that would be likely to be accepted by the ACCC pursuant to section 44ZZA(3) of the Trade Practices Act 1974 ('the Act', known as the Competition and Consumer Act 2010 (CCA) from 1 January 2011). This was to assist CBH, GrainCorp and ABB in each re-lodging a revised undertaking with the ACCC.
