The ACCC considered the competitive effects of the proposed acquisition in the context of the global market for airborne LiDAR bathymetry (ALB) survey services for clear shallow water surveys, focussing on the supply of these services in Australia.
Competition analysis
The ACCC formed the view that the proposed acquisition was unlikely to substantially lessen competition in the relevant market. Factors informing this conclusion included:
- the existence of global competitors capable of supplying their services to Australia;
- barriers to new entry and expansion did not appear to be insurmountable;
- some customers of the merger parties had the ability to conduct the relevant services in-house if necessary; and
- the dynamic nature of the relevant market, including market growth and technological innovation offering greater scope for new entry over time.
