ACCC takes action for breach of undertakings by Darwin tobacconist

The Australian Competition and Consumer Commission has filed Federal Court proceedings alleging breaches of court enforceable undertakings by a Darwin tobacconist, Colin Thompson.

The ACCC alleges Mr Thompson has failed to display anti-smoking posters in his retail outlet for three months as required by the undertakings provided to the ACCC by Mr Thompson.

The ACCC accepted the undertakings from Mr Thompson in resolution of allegations he had covered mandatory health warnings, images and Quitline information on cigarette packets with stickers.

The ACCC is seeking a declaration, an order requiring Mr Thompson to display the posters for a further three months and payment of the ACCC's court costs.

The first directions hearing will be held in the Federal Court, Darwin before Justice Mansfield at 9.15 a.m. August 5 2009.
