ACCC acts against Harvey Fresh (1994) Pty Ltd alleging misrepresentations about cheese origin

The Australian Competition and Consumer Commission has instituted proceedings in the Perth Federal Court against Harvey Fresh (1994) Pty Ltd alleging misrepresentations about the origin of some cheese products.

The ACCC alleges Harvey Fresh represented the place of origin of its one kilogram blocks of Matured Cheese and Semi Matured Cheese as being the south west of Western Australia when it was actually produced in Victoria.

The ACCC alleges that by making the representations, Harvey Fresh breached sections 52 and 53(eb) of the Trade Practices Act 1974. The claims were made on the cheese packaging and in newspaper advertisements.

The ACCC seeks declarations, an injunction and orders for corrective notices, trade practices law compliance training and costs.

A directions hearing is listed for 21 May 2009 at 10.15 a.m. before Justice Siopis.
