Summary
On 23 March 2009 and 8 April 2009, third line forcing notifications were lodged by a number of public health organisations (PHOs). PHOs are area health services, statutory health corporations and affiliated health organisations which conduct public hospitals in NSW.

Under the notified conduct, pathology services for private inpatients in NSW public hospitals must, unless it is not in the best interests of the patient, be supplied by pathology practitioners appointed by PHOs. The conduct is embodied in a policy issued by NSW Health.

On 25 August 2009 NSW Health advised that it is reviewing the policy in light of interested parties' concerns.

An amended policy was received by the ACCC on 17 February 2010. The notifying parties provided further information on 15 April 2010.

On 27 May 2010 the ACCC decided not to take any further action with respect to the notifications at this time.
