Water market rules and water charge rules

The Water Market Rules 2009 and the Water Charge (Termination Fees) Rules 2009 were registered by the Minister for Climate Change and Water (the minister) on 22 June 2009 and came into effect on 23 June 2009.

The Water Act 2007 provides that the minister may make water market rules and water charge rules.

On 11 February 2009, the minister issued a public notice proposing to make water market rules and water charge (termination fees) rules.

Copies of the registered rules and the explanatory statements are attached.






Guides

On 23 June 2009, the ACCC released both general and comprehensive guides to assist irrigators, operators and professional advisors to better understand and comply with the water market rules and water charge (termination fees) rules.


General guides for irrigators on the water market rules and rules on termination fees

The ACCC has released two guides that will provide an introduction for irrigators about the new water market rules and water charge rules governing termination fees. The first guide looks at issues related to transforming your irrigation right and maintaining delivery. The second guide looks at the issues related to permanently selling your water and terminating your delivery right.




A guide to the Water Market Rules 2009 and water delivery contracts

This guide provides compliance information to operators on the water market rules and information that may be useful for drafting water delivery contracts.

The water market rules require operators to undertake a number of actions during the transition period. Guidance on the actions required are discussed in the guide.


 

Water Charge (Termination Fees) Rules 2009 - Technical guide for irrigation infrastructure operators

This guide provides operators with technical information on the water charge rules governing termination fees.


 

Additional Information - Final advice to the Minister

Further information to assist stakeholders understanding of the rules can be found in the ACCC's final advice to the minister.

In registering these rules the minister accepted the ACCC's final advice regarding the water market rules and the water charge (termination fees) rules with the exception of the transitional period.

Details of the minister's decision to change the transitional period are included in the explanatory statements above.
