CS Energy sought to make a minor variation to authorisation A50027, which allowed CS Energy and Callide Power Management Pty Limited to jointly negotiate a price review with Anglo Coal under existing coal supply agreements each Applicant has with Anglo Coal, until December 2011. CS Energy proposed to agree with Callide Power Management to jointly undertake the negotiations with Anglo Coal on price, and possibly other areas, for the extension of their respective agreements.
On 25 February 2009, the Commission decided that the conduct for which the minor variation was sought was materially different to what was previously authorised and was therefore not minor. The application for a minor variation was denied.
