Review of the mobile terminating access service declaration
The ACCC has concluded its public inquiry into the declaration of the mobile terminating access service (MTAS) by releasing its final report on 28 May 2009.
In the final report, available below, the ACCC has decided to extend the declaration of the MTAS for five years.
In December 2008, the ACCC commenced a public inquiry under subsection 152AL of the Trade Practices Act 1974 to review the declaration of the MTAS.
The purpose of the review was to determine whether the current MTAS declaration should be remade, extended, revoked, varied or allowed to expire.
As part of the inquiry, the ACCC released a discussion paper on 18 December 2008. As indicated in the discussion paper, the ACCC requested written submissions by no later than 5.00 pm on 30 January 2009. The discussion paper is available below.
The ACCC received submissions from the Competitive Carriers' Coalition, Australian Telecommunications Users Group, Telsta, Optus, Vodafone, AAPT and Hutchison.
After reviewing interested parties' submissions and as part of the inquiry process, the ACCC released a Draft Report on 19 March 2009, available below, for public comment. The Draft Report sets out the ACCC's preliminary. Interested parties were invited to make written submissions by 5:00pm on 16 April 2009.
