Market definition
The ACCC considered the acquisition in the context of the national market for the manufacture and supply of fresh dairy products, including yoghurt and dairy desserts and regional markets for the acquisition of raw milk.
Competition analysis
The ACCC formed the view that the proposed acquisition would be unlikely to substantially lessen competition in the relevant markets. In particular, the ACCC considered that the merged entity would be constrained by the threat of expansion by existing competitors; the dynamic nature of the fresh dairy industry, including the high degree of product innovation and promotional activity; low customer brand loyalty; and competition from exiting market participants. The major supermarkets may also impose some constraint on the merged entity.
