Market definition
For the purposes of this competition assessment, the relevant markets considered were:
- the market for the supply of mining services for larger scale projects (tier 1); and
- the market for the supply of mining services for smaller scale projects (tier 2 and tier 3).
These markets were considered on a national basis.
Competition analysis
The ACCC considered that the proposed acquisition was unlikely to substantially lessen competition in any of the relevant markets as there was limited overlap between the operations of Macmahon and Ausdrill. The merged firm would also continue to be competitively constrained by existing mining service firms.
