Market definition
The proposed acquisition was considered in the markets for:
- the supply of engines to original equipment manufacturers (OEMs) for the production of mowers intended for Australian consumers (Engines Market); and
- the supply of mowers within Australia (Mowers Market)
Competition analysis
The ACCC formed the view that the proposed acquisition was unlikely to substantially lessen competition in the relevant markets because:
- there were sufficient alternative sources of engines available; and
- the merged firm would continue to face strong competition from the vertically integrated mower suppliers which would be unaffected by any foreclosure attempts by the merged firm.
