eBay proposes to supply the services offered on the eBay Site (including search, listing and transaction functions) to registered users of the eBay Site, on condition that users only acquire the online payment services provided by PayPal Australia Pty Ltd.
The ACCC issued a draft notice proposing to revoke eBay's notification on 12 June 2008 (available under 'ACCC decisions').
It is the ACCC's usual practice to provide parties with an indicative timetable which outlines the key dates, including dates when submissions will be due and timeframes within which the ACCC anticipates indicating its view on the notification.
The ACCC seeks submissions from interested parties in relation to the draft notice by 3 July 2008, via adjudication@accc.gov.au - further information regarding lodging a submission is available under 'ACCC Correspondence'.
eBay and interested parties may also call a pre-decision conference, a public meeting at which all interested parties may make representations to the ACCC, by COB 26 June 2008.
Regarding submissions:
The ACCC has discretion under the Trade Practices Act to exclude material from the public register if it is satisfied that it is desirable to do so, either because of the confidential nature of the material or for any other reason.
Regarding the documents found under the "Submissions" link below, the ACCC has assessed each of the submissions provided in this matter and exercised its discretion to exclude material such as personal details and confidential information.
Where there has been any uncertainty about the public nature of a submission, the ACCC has consulted the sender before placing the submission on the public register. In a number of submissions sent by email, the ACCC has consulted the sender before deleting the confidentiality disclaimer and placing the submission on the public register.
