The ACCC wishes to emphasise that many of the witnesses that attended hearings did not attend voluntarily; rather they were summonsed to appear under s. 95S of the Trade Practices Act 1974. In general, the ACCC summonsed all supplier companies (excluding industry representative organisations) irrespective of whether a company offered to attend voluntarily. Therefore, nothing can be drawn from the fact that a company appeared at the hearings.
The ACCC also wishes to emphasise that material covered in hearings may be confidential and commercially sensitive, and therefore some parts of the hearings were not open to the public. In particular, where a supplier company was summonsed, it is likely that parts of the hearing will remain confidential.
Transcripts of the public parts of the hearings are available below. The ACCC has also disclosed some aspects of confidential parts of a hearing if it considered that some of the material should be in the public domain. The ACCC consulted with the relevant witness before disclosing this information.
