Market definition
The ACCC considered the following relevant markets:
- state markets for the acquisition of raw milk in New South Wales and Victoria;
- state markets for the manufacture and wholesale of fresh milk in New South Wales, Victoria and Queensland; and
- the New South Wales market for the manufacture and wholesale of flavoured milk.
Competition analysis
The ACCC formed the view that the proposed acquisition was unlikely to substantially lessen competition in the relevant markets. In reaching this view, the ACCC considered that the extent to which Perfection Dairies currently acts as a competitive constraint on Dairy Farmers in the relevant markets is small and that the merged entity will continue to be constrained by several competing firms.
