Water

The ACCC has responsibilities in relation to water markets, water trading and water delivery services in the Murray-Darling Basin (MDB) under the Water Act 2007.

The ACCC also has responsibilities in relation to third party access to water–related infrastructure under Part IIIA of the Trades Practices Act 1974.

The ACCC does NOT have any role in relation to:

  • urban water supplies
  • water resources other than MDB resources.

Interested stakeholders are encouraged to make a written submission on the draft water market rules and draft water charge (termination fee) rules to inform the final advice to the Minister.

The ACCC is responsible for providing advice on water market rules, water charge rules and water trading rules under the Water Act 2007

The ACCC has been conducting formal consultation since April 2008 on the development of its advice on water market rules and water charge rules. During this consultation stakeholders have indicated they want more time to consider the draft rules. Accordingly, the ACCC requested, and the Minister has granted an extension to the deadline for the provision of advice. As a result of the extension, an additional ‘position paper’ stage has been included to provide more time for stakeholders.

Water charge rules must relate to regulated water charges and contribute to achieving the basin water charging objectives and priciples.

Water market rules are to relate to the actions of irrigation infrastructure operators that restrict or unreasonably delay transformation arrangements.
