Market definition
The ACCC considered that the relevant market for the proposed acquisition was the national market for beer.
Competition analysis
On 18 December 2007 the ACCC formed the view, after conducting market inquiries, that the proposed acquisition was unlikely to substantially lessen competiton in the relevant market. Factors informing this conclusion included that the merged entity would continue to be constrained by the presence of alternative bulk and packaged beer suppliers in Australia, in particular, the Foster's Group's beer division, Carlton United Breweries.
