Market definition
The proposed acquisition was considered in the context of separate markets for the supply of flat glass products and the supply of value added glass products.
Competition analysis
On 2 October 2007 the ACCC formed the view that the proposed acquisition is not likely to substantially lessen competition in the relevant markets due to a number of actual and potential competitors of flat glass and value added glass products which would be likely to constrain CSR from attempting to exercise market power. Additionally, the ACCC considered that the glass products supplied by DMS are not likely to be sufficiently complementary to CSR's building products range (due to different customer bases for the respective products) so as to raise conglomerate merger concerns under section 50 of the Act.
