Market definition
This acquisition was considered within the context of the Australian market for the supply of:
1. wool branding services (including licensing, quality assurance testing and marketing); and
2. international wool market intelligence.
Competition analysis
1. Australian market for the supply of wool brand services

Due to AWI's governance arrangements (non-profit status, ownership by woolgrowers, the terms of its statutory funding agreement), it appears unlikely that AWI has an incentive to direct levy funds in a way that discriminates in favour of Woolmark against any genuine project likely to improve wool sales. The acquisition of the Woolmark brand from AWS is unlikely to change AWI's pattern of incentives.

Further, AWI has always had the ability to fund its own branding exercises if it is dissatisfied with commercial efforts. Therefore, it appears unlikely that the acquisition will lead to a substantial lessening of competition in the Australian market for wool brand services.

2. Australian market for the supply of international wool market intelligence

The substantial number of strong competitors that will remain in this market means that it is unlikely that the acquisition will lead to a substantial lessening of competition in this market.
