CARTEL CONDUCT: warning signs in the procurement process
Procurement activities are a prime target for cartels. There are warning signs that can help identify suspected illegal cartel behaviour such as collusive tendering. Procurement officials and procurement agencies, with their detailed knowledge of specific industries, are often in the best position to report on suspected cartel conduct. Recent legislative amendments have significantly increased the civil pecuniary penalties that can be imposed on illegal cartel conduct. In addition, the Government has publicly listed legislation for introduction to parliament in 2007 to criminalise serious cartel conduct. This revised publication in CD form provides information on industry and behavioural warning signs that help detect cartel conduct in the procurement process.
